1. Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

2. Content

All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography.

Examples of unacceptable material:

File/Image Sharing scripts/sites, Rapid Leech Scripts 7. Proxy, Newsletter [Email Marketing] Scripts 8. Any Kind of Server Abusive Script/Program/Virus etc 9. Terrorist Activities Sites 10. IRC (Internet Relay Chat)

3. Zero Tolerance Spam Policy

You are not allowed to send any sort of unsolicited emails through any servers used by Bouncie Networks. Double opt-in mailing lists are allowed, as long as you don't send out 50 or more emails at once. You must not send bulk email, legal or not, bulk being to 50+ recipients at one time. You can send emails as long as the comply with the CAN-SPAM act. People found to be spamming will be warned, and accounts disabled until they re-accept the Terms of Service, if they are found to be spamming again, they will be permanently terminated, and their contact details given to relevant authorities if requested. For our resellers, we will not terminate your account if people are found to be spamming under your account, we will suspend their account, and contact you, if there is no reply, we will terminate their account for you. If there are excessive amounts of material on a resellers account, we will be forced to suspend the whole reseller, until the problems are sorted out fully

4. Payment Information

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify Bouncie Networks. of your desire to cancel any or all services received, those services will be billed on a recurring basis.

5. Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

7. FREE Migration From Previous Host

We can migrate/transfer a maximum number of 50 accounts from your previous host for FREE and the control panel of your previous host must be cPanel. If you have more than 50 accounts to migrate/transfer or the control panel is not cPanel, we will charge extra fee in those cases.

8. Resource Usage

Users may not initiate the following:

a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

9. Price Change

Bouncie Networks reserves the right to change the prices of its hosting plans at any time. This only applies to recurring payments or new customers. It means that if you buy 3 months of hosting, and the price changes during your contract period, you will not have to pay more to keep your hosting account active until the contract period ends. If you want to continue the hosting, then you will have the pay the higher, or lower price. If you find that you cannot afford to pay the price of the new hosting, we will give you 3 days to backup your account until it is terminated.

10. Hosting Plan Change

Bouncie Networks reserves the right to change hosting plan features anytime. Which includes, Disk Space, Bandwidth, Maximum CPU/RAM Usages etc..

11. Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Bouncie Networks's server.

12. Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

13. Suspension and Termination

If you or any of our reseller's client violate any of the above policies, Bouncie Networks reserves the right to suspend/terminate the account or reseller's client account at any time without any warning.

14. Changes to the TOS

Bouncie Networks reserves the right to revise the Terms of Service at any time without notice.

User Agreement

1. You, as the user of any Bouncie Networks services, agree to abide by these Terms Of Service. Failing to do so, may result in account suspension/termination.

2. You, as a user of any Bouncie Networks services, agree that if you have any problems, you will use the live support, ticketing support system, and leave a support ticket - before going to PayPal/2CheckOut (2CO)/MoneyBookers/AlertPay/Liberty Reserve or other third parties to get your money back. eg. If you have a problem with your service, you must create a support ticket in your clients area, if you decide to report us to PayPal/2CheckOut (2CO)/MoneyBookers/AlertPay/Liberty Reserve, before even requesting a refund, you are breaking these Terms Of Service. By breaking the terms of service you risk termination of this contract, therefore you are liable for NO refund, NO Charge back, you risk getting suspended, terminated and banned from Bouncie Networks.

3. You agree to be not abuse Bouncie Networks staff.
